If you are arrested on an old outstanding warrant, it is possible to argue that it be dismissed for lack of evidence. The legal system is not always against you. What happens to my bail if I fail to appear in court?

As per any bond agreement, you are to show up in court on your assigned date. This fulfills the agreement you took out with your bond agency. The position of the bond agency was to post your bail in return for your cooperation in court. If you fail to adhere to these terms, there are consequences with your agency. Once you fail to appear in court, you have now entered bond forfeiture. Bond forfeiture means that any money the agency posted on your behalf is now gone. You must pay back the bond in full. In the state of North Carolina, there are exceptions to these terms. There is a 150 day grace period for the defendant to contact their agency and attempt to work things out. If you are charged with a separate crime and are held at another facility, that is the only acceptable excuse for failing to appear in court. If that is not the case,. you may have forfeited your bond. There can then be a bond forfeiture hearing, unless an agreement is reached outside of court. It is always better to be vigilant in appearing in court. Nothing is ever made better by failing to appear.
