What is bail?

When someone is arrested, they are taken to jail. Once processed, the individual is under the care of the state, and will be in jail until their court date. To avoid this, and to be released until the court date, there is the option to be bailed out. Bail is money paid to the court to let the accused person walk freely until their hearing. Often, bail is set for relatively low amounts that are easily posted by family or friends. Sometimes, however, the price may be too high for an average person to post. This is where bonding agencies come in.

How do bail bonds work?

Bail bonds are created through a deal between you and the bonding agency. The bonding agency will agree to pay the court to release the accused from jail. Upon doing this, the agency has agreed to take responsibility for the accused until their appointed court date. Once the accused has appeared in court on their set date, the bonding agency has fulfilled its duties. When contacting a bonding agency, you may be asked to stake collateral for the amount needed to post bail. Collateral can come in the form of real estate, your car, or even appraised jewelry. Don’t worry! As long as the defendant arrives in court at the appointed time, your personal possessions are not at risk of being lost. This is just to ensure that trust is established between yourself and the bonding agency. If the court date is missed, however, much larger issues are sure to arise.

What happens if a court date is missed?

Sometimes, people miss court dates entirely by mistake. Other times, people think it wise to try to evade the law. It is important to note that if any person attempts to run from the law before their court date, they will absolutely be found. Not only will the posted bond be forfeited, the defendant will now be facing a misdemeanor failure to appear charge, in addition to the original charge. If this happens, the best thing to do is surrender to the court and cooperate with the law to the fullest extent. Sometimes, failures to appear can be dismissed with proper compliance and legal representation. However, it is always best to make sure that if you or a loved one are set to appear in court, that date is not missed.
